このところAIによる処理が雨後の筍のように次から次へと出てきます。わたしたちAdobeユーザーもこの波には逆らえないわけでして、Fireflyのベータ版なんかで色々試されている方も多いかと思います。という事で、今回お届けするのはAdobe社の提供するGenerativeAI機能を利用する際に読んでおかなければならない文書についてです。「Adobe Creative Cloud ジェネレーティブ AI ベータ版追加条件」という文書なのですが、日本語版がまだ存在しませんので対訳形式でお届けいたしますです。
以下、対訳となります。
Adobe Creative Cloud Generative AI Beta Additional Terms
These Additional Terms govern your use of beta generative AI features in our Services and Software and are incorporated by reference into the Adobe General Terms of Use (“General Terms”) located at www.adobe.com/go/terms (these Additional Terms and the General Terms are collectively referred to as “Terms”). Capitalized terms not defined here have the same meaning as defined in the General Terms.

本追加条件は、Adobe社のサービスおよびソフトウェアにおけるベータ版ジェネレーティブAI機能の使用を規定し、Adobe General Terms of Use（https://www.adobe.com/go/terms、日本語版https://www.adobe.com/jp/legal/terms.html）に組み込まれます。（本追加条件および一般条件を総称して「条件」と表記）ここで定義されていない大文字の用語は、一般条件で定義されているものと同じ意味を有します。
1.Generating Content. When you use generative AI features, you may be asked to input or upload material, such as an audio file, video file, document, image, or a text prompt (collectively “Input”). The Input will be used by the Services and Software to generate an output, such as an image, text, text effects, vector graphic, audio file, or video file, which will be displayed within the Services and Software (“Output”). The Input and Output are your Content and all provisions governing Content in the Terms apply to the Input and Output; provided, however, that you may not use the Output for any commercial purpose. The generative AI features, Input, and Output must be used in accordance with the Adobe Generative AI Beta User Guidelines located at https://www.adobe.com/go/adobe-gen-ai-user-guidelines (“Guidelines”), which may be modified from time to time. Adobe reserves the right to throttle, limit, disable, suspend, or terminate your right to use or access the generative AI features at any time in our sole discretion.

1.コンテンツの生成
ユーザーがジェネレーティブAI機能を使用する場合、オーディオファイル、ビデオファイル、ドキュメント、画像、またはテキストプロンプトなどの素材（以下、総称して「インプット」と表記）の入力またはアップロードを求められる場合があります。インプットは、本サービスおよびソフトウェアによって使用され、本サービスおよびソフトウェア内に表示される画像、テキスト、テキスト効果、ベクターグラフィック、オーディオファイル、またはビデオファイルなどのアウトプット（以下、「アウトプット」と表記）を生成します。インプットおよびアウトプットはユーザーのコンテンツであり、本規約のコンテンツに関するすべての規定がインプットおよびアウトプットに適用されますが、商用利用は許可されません。ジェネレーティブAIの機能、インプット、およびアウトプットは、https://www.adobe.com/go/adobe-gen-ai-user-guidelines（以下、「ガイドライン」と表記）にあるAdobeジェネレーティブAIベータユーザーガイドライン（以下、「ガイドライン」と表記）に従って使用する必要があります。Adobeは、独自の裁量で、ジェネレーティブAI機能を使用またはアクセスするユーザーの権利をいつでも制限、無効化、一時停止、または終了する権利を留保します。
2.Input. You are solely responsible for your Input. You must not submit any Input that: (a) includes trademarks or other materials protected by third-party Intellectual Property Rights, unless you have sufficient rights in such materials; (b) is intended to generate Output that is substantially similar to a third party’s copyrighted work or is otherwise protected by third-party Intellectual Property Rights, unless you have sufficient rights in such work; (c) violates applicable law; or (d) violates the Guidelines. We may automatically block your Input, in our sole discretion, if we believe it violates the rights of a third party, applicable law, our Guidelines, or our Terms.

2.インプット
ユーザーはインプットに対して単独で責任を負うものとします。ユーザーは以下のようなインプットを行ってはなりません
（a）第三者の知的財産権によって保護されている商標またはその他の素材が含まれるもの（当該素材について十分な権利を有している場合を除く）
（b）第三者の著作権で保護されている作品と実質的に類似しているか、または第三者の知的財産権によって保護されているアウトプットを生成することを意図したもの（当該作品について十分な権利を有している場合を除く）
（c）適用法に違反したもの
（d）ガイドラインに違反したもの
第三者の権利、適用法、ガイドライン、または本規約に違反していると当社が判断した場合、Adobeは独自の裁量でユーザーのインプットを自動的にブロックすることができます。
2.1 Personal Information. While we encourage you not to input or upload personal information into generative AI features, if you use the Services and Software to process personal information, including using personal information in your Input, you must comply with all data protection and privacy laws and regulations applicable to personal information you process in the Services and Software, including providing privacy notices and obtaining consent, where required.

2.1 個人情報
Adobeは、ユーザーが個人情報をジェネレーティブAI機能にインプットまたはアップロードしないことを推奨しますが、ユーザーが本サービスおよび本ソフトウェアを使用して個人情報を処理する場合（ユーザーのインプットに個人情報を使用する場合を含む）、ユーザーは、必要に応じてプライバシー通知を提供し、同意を取得することを含め、本サービスおよび本ソフトウェアで処理する個人情報に適用されるすべてのデータ保護およびプライバシーに関する法律および規制を遵守する必要があります。
3.Output.

3.1 Your Responsibilities. You are solely responsible for the creation and use of the Output and for ensuring the Output complies with our Terms and our Guidelines; however, we may use available technologies, vendors, or processes to screen for and block Output that may violate applicable law, the rights of a third party, our Terms, or our Guidelines before the Output is delivered to you. Adobe disclaims all warranties, express or implied, regarding the Output, including any implied warranties that the Output will not violate the rights of a third party or any applicable law. In addition, you must not remove or alter any watermarks or Content Authenticity Initiative metadata (e.g., Content Credentials) that may be generated with the Output, or otherwise attempt to mislead others about the origin of the Output. 3.アウトプット
3.1 ユーザーの責任
ユーザーは、アウトプットの作成および使用、ならびにアウトプットが適用条件およびガイドラインに準拠していることを確認することについて、単独で責任を負うものとします。ただし、Adobeは、利用可能な技術、ベンダー、またはプロセスを使用して、アウトプットがユーザーに配信される前に、適用法、第三者の権利、適用条件、またはガイドラインに違反する可能性のあるアウトプットをスクリーニングし、ブロックする場合があります。Adobeは、アウトプットが第三者の権利または適用法令に違反しないことを含む黙示の保証を含め、明示または黙示を問わず、アウトプットに関するすべての保証を放棄します。さらに、ユーザーは、アウトプットに付加されるウォーターマークまたはContent Authenticity Initiativeのメタデータ（Content Credentialsなど）などを削除または変更したり、アウトプットの出所について他者を誤解させようとしたりしてはなりません。Content Authenticity Initiativeについては、https://contentauthenticity.org を参照してください。
3.2 Suitability of Output. Use of generative AI features may produce Output that is unexpected or unsuitable for some users. The Output may not be unique and other users of generative AI features may generate the same or similar Output. The Output might not be protectable by Intellectual Property Rights.

3.2 アウトプットの適合性
ジェネレーティブAI機能の使用は、一部のユーザーにとって予期しない、または不適当なアウトプットを生成する可能性があります。アウトプットは一意でない可能性があり、ジェネレーティブAI機能の他のユーザーが同じまたは類似のアウトプットを得る可能性があります。アウトプットは知的財産権で保護されない可能性があります。
3.3 Exceptions. Notwithstanding anything set forth in these Terms to the contrary, Section 8.2 (Indemnification) of the General Terms does not apply to Output.

3.3 例外

4.Licenses to Adobe.
4.1 Firefly Gallery. If you submit Output to the Firefly gallery, which is a feature of Firefly Beta, you grant us a non-exclusive, irrevocable, worldwide, royalty-free license to use, reproduce, distribute, modify, sublicense, create derivative works based on, publicly display, publicly perform, or translate both the submitted Output and the corresponding Input for marketing purposes and to allow other Firefly Beta users to use said Input and Output to generate their own Output.

4.1 Fireflyギャラリー
ユーザーがFirefly Betaの機能であるFireflyギャラリーにアウトプットを提出した場合、ユーザーは、提出されたアウトプットおよび対応するインプットの両方をマーケティング目的で使用、複製、配布、変更、サブライセンス、派生物の作成、公の場での表示、公の場での上演、または翻訳する非独占的、取消不能、世界的、ロイヤリティフリーのライセンスをAdobeに付与し、他のFirefly Betaユーザーが当該インプットおよびアウトプットを使用して独自のアウトプットを生成することを許可するものとします。
4.2 Product Improvement. In addition to Adobe’s rights described in Section 3.11(A) of the General Terms, Input and Output from your use of generative AI features may be used to train and improve our Services and Software.

4.2 製品の改善
一般条件の第3.11条（A）に記載されているAdobeの権利に加え、ユーザーによるジェネレーティブAI機能の使用によるインプットおよびアウトプットは、当社のサービスおよびソフトウェアを訓練および改善するために使用される場合があります。
以上が全文となります。要点を解説しておきましょう。
現在「ジェネレーティブAI機能」と称されるものはFireflyサービス（AdobeExpressに内蔵されたもの含む）、Photoshopベータ版のAI生成機などが該当します。これらを利用すると画像にウォーターマークやメタデータが付加されたりすることがあります。こういった情報を編集・削除してはいけません。また、生成物は個人での利用に限り、商用利用は禁止されています。
生成物に対する責任はユーザーにあり、ユーザーはガイドラインを遵守することを求められます。
Adobe社自身はジェネレーティブAI機能による成果物に対してなんの保証もせず、問題が生じた場合は全面的にユーザーの責任となります。また、生成物に対しては知的財産権が認められない可能性があることにも注意が必要です。
Adobe社はユーザーの入力及び出力に対してスクリーニングを行い出力をブロックすることがあります。
ガイドラインを遵守しているにもかかわらずブロックされるケースもあります。誤検知と考えられる場合はプロンプト入力時の言い回しを変更するなどで改善可能です。
と、まあ、重要なところはこれぐらいなんですけど、Adobe社のジェネレーティブAI機能はトレインデータを慎重に選択して知的財産権関連の問題を回避していますが、Adobe社は出力に対する保証を行っていません。将来的にFireflyのエンタープライズ版のみIP関連の補償を行うとアナウンスしましたが、一般に向けたバージョンではなんの補償も無くユーザーの自己責任の世界です。同様にPhotoshopベータ版の生成塗り機能に関しても商用利用は許可されていません。
Fireflyは2023年9月のPhotoshop2024リリースの際に正式サービスとして立ち上がりました。生成結果は商用利用可能となっています。また、Adobe Stockを経由してクレジットを消費することで個人版利用者においても補償が付くようになっています。
Adobeに限らず、他のジェネレーティブAIによる出力は知的財産権のリスクが存在しますから利用の際は細心の注意が必要です。
